Two Thresholds. Two Licensing Tracks.

South Carolina Draws a Clear Line Between Residential and Commercial Contracting.

The state does not use one single dollar threshold for every contractor. Residential building and commercial/general or mechanical contracting sit under different licensing chapters, which is why the agreement should know what type of project it is dealing with.

$5K+ Residential Building

Residential builder licensing starts above the $5,000 line.

South Carolina's residential builder definition covers qualifying construction, repair, improvement and reimprovement of residential buildings when the cost of the undertaking exceeds $5,000.

Residential specialty contracting is separately regulated. Specialty work generally enters the registration framework when the undertaking exceeds $500, and current South Carolina LLR guidance requires a $5,000 surety bond when the total project cost exceeds $5,000.
$10K+ General + Mechanical Contracting

Commercial contractor licensing now uses the $10,000 threshold.

For general contracting and mechanical contracting under Chapter 11, a state contractor license is required when the total cost of construction is greater than $10,000.

That threshold was increased from $5,000 to $10,000 in 2023, making current wording important when describing the South Carolina commercial licensing position.

Residential Licensing Has Teeth

NO LICENSE. LESS LEVERAGE.

South Carolina does more than simply require the correct license or registration. For covered residential building or residential specialty contracting, a person or firm that was legally required to be licensed or registered and entered the contract in violation of that requirement can lose important enforcement tools.

The contract and the license status are connected.

South Carolina's residential builder law says a contractor who was required to be licensed or registered but was not may not file a mechanics' lien or bring an action at law or in equity to enforce that noncompliant residential contract.

Mechanics' lien rights can be affected.
Contract enforcement can be affected.
Registration matters for specialty work too.
Local license rules can still sit on top.
How We Build the South Carolina Edition

The Trade Comes First. The State Layer Comes Next.

We do not start with a generic legal form and rename it for South Carolina. Contractor experience identifies the real project problems first. Attorney knowledge strengthens the wording and structure. Then the South Carolina layer addresses the licensing, cancellation, defect, lien and project-specific rules that can change the paperwork.

Contractor Experience

Start with the disputes that actually happen.

Scope changes, access, hidden conditions, additional work, delays, approvals, customer-supplied items, payment timing and completion issues are mapped from real construction experience.

Attorney Knowledge

Turn practical knowledge into professional terms.

Attorney input helps translate those real-world risks into clearer contractual structure, responsibilities, payment mechanics and dispute wording.

South Carolina Law

Then make the agreement fit the jurisdiction.

Residential and commercial licensing thresholds, home-solicitation rights, defect procedure, lien timing and local requirements are treated as part of the state edition.

South Carolina Defect Claims

90 / 30 / 10 — A Built-In Chance to Deal With the Problem Before Court.

South Carolina's Notice and Opportunity to Cure Construction Dwelling Defects Act creates a pre-suit process for qualifying dwelling defect claims. For contractors, that makes inspection, written responses, repair proposals and record keeping especially important.

90Days Before Filing

The claimant serves written notice.

The homeowner claimant must generally serve written notice of the alleged construction defect no later than 90 days before filing the action.

30Days After Service

The contractor chooses how to respond.

The contractor or subcontractor has 30 days to inspect, offer to remedy, offer to settle or deny the claim. No response within that period is treated as a denial.

10Days After an Offer

The claimant responds to the offer.

If the contractor makes an offer, the claimant generally has 10 days after receiving it to serve a response.

South Carolina Mechanics' Liens

The Clock Starts When the Work Stops.

South Carolina lien rights are time-sensitive. Contractors should treat the end of labour or material supply as a trigger to review what is owed, what notices are required and whether lien action is still available.

90 DAYS

Serve and file the lien statement.

Section 29-5-90 provides that the lien is dissolved unless the claimant, within 90 days after ceasing labour or furnishing labour or materials, serves the owner and files the required sworn statement in the appropriate county office.

6 MONTHS

Start the enforcement action.

Section 29-5-120 provides that the lien dissolves unless suit to enforce it is commenced and notice of pendency is filed within six months after the claimant ceases labour or furnishing labour or materials.

3RD

Business Day Cancellation Rights Can Apply to Home Solicitation Sales.

South Carolina's Consumer Protection Code gives a buyer the right to cancel a qualifying home solicitation sale until midnight of the third business day after signing, subject to statutory scope and exceptions.

Written cancellation notice matters. The statutory framework includes specific notice wording and tells the buyer where cancellation must be sent.
Emergency work is treated differently. The law contains an exception where the buyer makes a separate signed emergency request meeting the statutory conditions.
Do not treat it as a blanket three-day rule. The right applies to qualifying home solicitation sales, so the way the transaction was made matters.
State LICENSE. Local Rules.

South Carolina Still Leaves Room for County and Municipal Requirements.

Residential specialty contractors are not exempt from county and municipal business-license or regulatory ordinances. That means a contractor can be correctly registered at state level and still need to check the locality where the job is actually being performed.

CharlestonCheck local business licensing, permits and inspection requirements for the project location.
ColumbiaState licensing does not remove city or county permit and business obligations.
GreenvilleProject type, trade and locality can change the compliance path.
Myrtle BeachCoastal and local project requirements should be checked before work starts.
SpartanburgLocal licensing and permit rules can sit alongside state contractor law.
StatewideThe contract should identify the actual project, contractor and location rather than assume one statewide process covers everything.

South Carolina Construction Contract FAQs

South Carolina Contract Questions Contractors Should Know.

When does South Carolina require a residential builder license?

South Carolina defines a residential builder to include qualifying residential construction, repair, improvement or reimprovement when the cost of the undertaking exceeds $5,000. Residential specialty contractors are separately regulated.

When does South Carolina residential specialty contractor registration apply?

South Carolina's Residential Builders Commission generally treats specialty contracting as covered when the undertaking exceeds $500. Current LLR guidance also requires a $5,000 surety bond when the total project cost exceeds $5,000.

What is the commercial contractor licensing threshold in South Carolina?

Under South Carolina's general and mechanical contractor statute, a state contractor license is required for regulated general contracting or mechanical contracting when the total cost of construction is greater than $10,000.

Can an unlicensed residential contractor still file a mechanics' lien?

If a contractor or firm was legally required to be licensed or registered under South Carolina's residential builder law and entered the contract in violation of that requirement, the statute can bar the contractor from filing a mechanics' lien or bringing an action to enforce that contract.

How does South Carolina's construction-defect notice process work?

For qualifying dwelling defect claims, the claimant generally serves written notice at least 90 days before filing the action. The contractor then has 30 days to inspect, offer to remedy, offer to settle or deny the claim, and the claimant has 10 days to respond to an offer.

How long does a contractor have to file a mechanics' lien in South Carolina?

South Carolina generally requires the lien statement to be served and filed within 90 days after the claimant ceases labour or furnishing labour or materials. The enforcement action and notice of pendency generally must then be filed within six months after that point.
